TANA Mfg. Co's. products are warranted for a period of five years against
defects in materials and workmanship. TANA Mfg. Co. MAKES NO OTHER
WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO ANY IMPLIED
WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. User is
responsible for determining whether TANA Mfg. Co.'s products are fit for a
particular purpose and suitable for user's requirements.
LIMITATION OF REMEDIES AND LIABILITY: If a TANA Mfg. Co. product is proved defective in material or workmanship, THE EXCLUSIVE REMEDY, AT TANA MFG. CO.'S OPTION, SHALL BE TO REFUND THE ORIGINAL PURCHASE PRICE TO THE ORIGINAL PURCHASER OR TO REPAIR OR REPLACE THE DEFECTIVE PRODUCT. TANA Mfg. Co. shall not otherwise be liable for loss or damages, whether direct, indirect, special, incidental, or consequential, regardless of the legal theory asserted, including negligence, warranty, or strict liability. |
